Archiving Act of 496AER[]

Section I: Administration[]

I: The Archiving Act regulates the conditions for the public archival work.

II: The Act is administered by the Ministry of Justice, as state archives belong under this ministry. 

Section II: Releasing Information[]

I: Material from public administrations must be available within seven to twenty one days. 

  • - Ia: Administrations have the right to reserve documents from publication so long as they have valid reasoning and submit a request for this to the home secretary. If a request is undergoing reviewal then said document shall be withheld from publication until a formal response is given.

II: If the material contains information of individuals, the deadline is extended to thirty years, and the transferring authority (Ie: The government) may extend the period to a maximum of sixty years, if one or more circumstances apply:

  • - IIa: The state secretary of defense of the realm: The Ministry of Defence cases is typically a period of 60 years
  • - IIb: The state’s foreign and economic interests, including relations with foreign powers or international organisations
  • - IIc: Protecting witnesses, accused or others in matters of criminal or disciplinary proceedings. 
  • - IId: Private or public intrests where secrecy for other special circumstances required. There is a deadline of twenty five years for royal matters and one-hundred years for official designs of government offices and premises. 
  • - IIe: However, documentation must be provided to the Federal Government, regardless of these deadlines, if requested.

III: Access can be granted to sruch materials that are not yet publicly available. This requires an application to the Ministry of Justice where upon justification is required for the access to documents. 

  • - IIIa: The Ministry of Justice has the full right to deny an application if they deem the reasoning invalid.
